Family left ‘devastated’ in Staten Island hit-and-run to sue NYC for $101M: lawyer

A “heartbroken” family whose father and daughter were severely injured in a hit-and-run accident in Staten Island plans to file a lawsuit against the city seeking $101 million in damages, The Washington Post has learned.

Guy Seth and his 6-year-old daughter were charged with fleeing the scene of an accident after they were struck by Staten Island pediatrician Sam Rouge while crossing the road in January, authorities said.

Police say Luuzzi, 66, was driving a black GMC truck when he struck Seth, 52, and his daughter Zoe, who was riding on her father's shoulders, as they were crossing busy Arthur Kill and Drumgoole roads in Green Ridge on Jan. 9.

Dr. Sam Luzzi was arrested in January on a misdemeanor charge of failing to report an accident, police said.
He pleaded not guilty and was released on bail. His criminal case is pending. Staten Island Advance

Ravi Batra, the family's attorney, who filed the lawsuit against the city, said the girl suffered a fractured skull that required surgery and that her father suffered a “devastating traumatic brain injury.”

Reuzzi is not named in the pending lawsuit.

The lawsuit alleges that the city's transportation department “negligently designed and created a dangerous intersection at Arthur Kill Road and Drumgoole.” [Road] “West.”

Mr Butler told the Post the intersection “has been known for many years as a defective and dangerous intersection, with missing green arrows controlling the two left-turn lanes from Arthur Kill Road to Drumgoole Road West”.

Zoe fractured her skull in the accident and said: “I have a titanium plate in my skull.

Batra said Seth was making nearly $300,000 a year as a waiter at the Waldorf Astoria Hotel before the pandemic and later worked in the city's maintenance department, but is now “virtually unable to leave the house” and Zoe “has a titanium plate in her head.”

The city's Law Department declined to comment on the allegations.

Police said Reuzzi was arrested in January on a misdemeanor charge of failing to report an accident. He denied the charge and was released on bail.

That case is pending.
