Fan Sues Colorado Rockies After Foul Ball Incident
Timothy Roeckel, a resident of Parker, Colorado, has filed a lawsuit against the Colorado Rockies following an incident during a game against the New York Yankees on July 16, 2023. He claims to have suffered “catastrophic and permanent injuries” after a foul ball hit him in the face while he was in a luxury box at Coors Field.
According to Roeckel, the design of the stadium contributed to the accident. He argues that specific architectural features, like the high ceilings of luxury boxes and overhanging bleachers, obstructed his view of the ball, making it impossible for him to avoid it.
The lawsuit states that the Rockies violated the Colorado Baseball Audience Safety Act of 1993 by failing to take reasonable precautions to ensure the stadium was safe for spectators. Roeckel claims the team was already warned about the dangers associated with their inadequate netting but did nothing to address the issue.
In addition, the suit points to the Rockies’ disappointing performance, which has reportedly led to reduced fan engagement and increased risk for spectators. Roeckel’s legal team argues that a lack of exciting gameplay means fans, especially those in high-end suites, are less attentive to the action on the field.
The overall atmosphere at the stadium has shifted, according to the lawsuit, focusing more on socialization and dining rather than the game itself. This cultural change is said to stem from the team’s unique marketing and design strategies.
As reported, the Rockies were struggling with a record of 35-58 at the time of the incident, a pattern that, unfortunately, appears to have continued this season.
Roeckel plans to take his case to court and is seeking financial compensation for his injuries and damages.
