Fani Willis flouts subpoena for testimony in Georgia Senate probe – enforcement ordered

Embattled Fulton County District Attorney Fani Willis on Friday refused to comply with subpoenas for testimony and documents related to alleged misconduct in her handling of the 2020 election interference case against former President Donald Trump.

A Georgia Senate special committee issued the subpoena last month as part of an investigation into the 52-year-old district attorney's alleged misuse of taxpayer money and potential conflicts of interest during his relationship with President Trump's former special counsel, Nathan Wade.

Willis has argued that the committee's subpoena powers are “unlawful” and has indicated he will refuse to cooperate with the investigation.

Before the hearing ended, Cowsert said the committee had hired outside legal counsel “to assist with the legal enforcement of the subpoena.”

Willis is challenging the lawfulness of the subpoena, but her appeal to have it quashed has yet to be heard in court.

Willis' lawyer, former Georgia Democratic Gov. Roy Burns, said: Atlanta Journal-Constitution The prosecutor said he would not appear in court until a judicial decision is made on the validity of the subpoena.

In court filings, Burns argued the committee's requests were “overbroad and not reasonably consistent with any legitimate legislative need” and “seek confidential and privileged information, as well as private and personal information that is not legitimately subject to a legislative subpoena.” Associated Press.

They also argued that the subpoenas should be void because they were issued after the state legislature was in session, violating the Georgia Constitution.

According to the Associated Press, the documents requested by the committee included Willis' materials related to Wade, including employment and payment information, records of communications between the two, and documents about any money or valuables that Wade and Willis may have exchanged.

The committee also is seeking the district attorney's responses to requests from members of Congress, as well as any communications Willis or her office had with the White House, the Justice Department or Congress regarding the 2020 election.

Wade resigned from the Trump lawsuit in March after Fulton County Judge Scott McAfee issued an ultimatum forcing either Wade or Willis to resign in order for the case to move forward.

While Willis and Wade both acknowledged being romantically involved, the affidavit alleges the relationship only officially began in 2022, after he filed charges against the former president and his co-defendants.

Willis's wide-ranging organized crime case against Trump has been on hold since June while a Georgia appeals court considers the former president's effort to have the district attorney disbarred.

Trump and eight of his co-defendants asked the Georgia Court of Appeals in March to hear arguments accusing Willis of prosecutorial misconduct regarding his relationship with Wade.

The appeals court is scheduled to hear arguments on the disqualification challenge in December, after the Nov. 5 presidential election.

The state senate's findings will likely feed into legislative action, including legislation, to ensure greater accountability and oversight of district attorneys' offices. According to the Georgia Senate.
