New York Attorney General Letitia James has been indicted on fraud charges by a federal grand jury in Virginia, as of Thursday. The allegations, which include bank fraud and submitting false statements to financial institutions, arise from claims about her Virginia property that was said to be a secondary residence.

The investigation reportedly initiated after Federal Housing Finance Agency Commissioner Bill Pulte provided a referral, suggesting that James distorted information to obtain better mortgage terms. Prosecutors allege that she misrepresented the status of her principal residence in mortgage documents for a property she bought in Norfolk, Virginia, in 2023. Supposedly, she inaccurately declared the Norfolk property as her primary residence, which influenced the interest rate applied to her loan.

Additionally, prosecutors are looking into her Brooklyn brownstone and the context of her official relationship with her father as stated in various documents. When seeking a mortgage, lenders typically ask about family connections to verify residency, co-signing, and assess financial history. Misrepresenting such details could lead to a significant legal issue under federal law, forming part of the basis for the indictment’s claim of making false statements to financial institutions.

In response to the allegations, James has publicly denied any wrongdoing, labeling the charges as “baseless” and politically driven. Her legal team contends that any discrepancies were unintentional and quickly rectified, asserting that there was no intent to deceive lenders.

The prosecution of James’ case is being handled by Lindsey Harrigan, a former lawyer for Trump who now serves as the U.S. attorney for the Eastern District of Virginia. Each charge she faces could potentially lead to a maximum sentence of 30 years in prison. However, legal analysts note that proving fraudulent intent poses a significant challenge for federal prosecutors.

It’s worth mentioning that updates have recently emerged, indicating that James faces additional charges beyond the initial count of mortgage fraud, which had been previously reported inaccurately.
