Federal Judge Finds Numerous Maryland Gun Bans Unconstitutional

On August 2, 2024, U.S. District Judge Gerald L. Russell ruled that many of Maryland’s firearms prohibitions targeting concealed carry persons are unconstitutional.

Case, Novotny vs. MooreThe lawsuit was filed by the Firearms Policy Coalition, the Second Amendment Foundation, Maryland Challenging Issues Inc. and several private citizens.

After reviewing the evidence, Russell sided with the plaintiffs. Summary judgment was granted. They oppose Maryland’s ban on carrying concealed guns on private property without the landowner’s consent, as well as bans on “possessing a gun near a public demonstration or in any place where alcohol is sold for the purpose of being consumed on the premises.”

Russell further noted that the three laws are “permanently prohibited.”

Adam Kraut, executive director of the Second Amendment Foundation, responded to Russell’s decision: To tell“We are pleased that the Court found Maryland’s strict ‘anti-carry’ rules unconstitutional. Such provisions are at odds with the history and traditions of our nation. Of course, we will review the Court’s opinion and explore our appellate options to continue challenging other provisions that we believe are unconstitutional.”
