Federal Judge Prevents 'Alligator Alcatraz' from Growing Further

Immigration Detention Center Expansion Blocked by Judge

A federal judge has prohibited any further expansion of the “Wannial Catraz” immigration detention facility by issuing a temporary injunction.

This interim injunction, granted by US District Judge Kathleen Williams, reinforces a previous suspension made two weeks ago. Detractors of the facility claim that further development goes against environmental regulations.

Environmental advocates and the Mikkoski tribe have insisted that any ongoing construction and operations at the center should cease until there is compliance with both state and federal environmental laws. Their legal action argues that the detention centers pose a risk to sensitive wetlands that are crucial for local flora and fauna, potentially undoing significant environmental recovery efforts.

On the other hand, state and federal attorneys contended that the facility’s construction and operation fall under state jurisdiction, asserting that federal environmental laws do not apply in this case. However, the judge concluded that the center functions as a partnership involving both state and federal interests.

In her ruling, Williams ordered the removal of fencing, lighting, and generators, directing that only current detainees remain at the facility. She also allowed for repairs and changes to the existing infrastructure solely for enhancing safety or addressing environmental risks.

“What’s evident is that in their haste to construct a detention camp, the state overlooked alternative sites,” Williams noted.

Jeremy Redfern, a spokesperson for the Florida Attorney General’s Office, criticized the decision.

“Judge Williams and the same district recently declined to hear the case, asserting that the Southern District of Florida was not the right venue for lawsuits related to Crocodile Alcatraz,” Redfern remarked. “Once again, she is overstepping her authority, and we plan to appeal this ruling.”

Florida Governor Ron DeSantis indicated that the state would pursue an appeal and remain confident in their position.

“We were anticipating a wholly unfavorable ruling,” he shared. “We were prepared to appeal immediately. This will not deter us. We intend to proceed with our efforts to assist the Trump administration in removing undocumented immigrants from our country.”
