Federal Judge Rules Against Warrantless Immigration Arrests in Oregon

A federal judge determined that federal agents likely broke the law by conducting a series of unlawful arrests, leading to a mandate that the Department of Homeland Security (DHS) cannot execute warrantless immigration arrests in Oregon without first evaluating the individual’s flight risk.

U.S. District Judge Mustafa Kasbai issued a preliminary injunction in response to a class action lawsuit against DHS and U.S. Immigration and Customs Enforcement (ICE) as the case moves forward.

The court found that immigration enforcement routinely apprehended individuals suspected of violations without warrants, neglecting to assess their potential to flee prior to obtaining a warrant.

Kasbai instructed the government to inform immigration officials, agents, and contractors about the ruling, and to maintain detailed documentation and reporting of warrantless arrests, including specific justifications for each case.

There was a significant emphasis on the evidence presented that revealed Oregon immigration officials applying force to carry out arrests without warrants or a proper risk assessment. During an extensive hearing, one of the plaintiffs, Victor Cruz Gamez, shared his experience of being detained for three weeks despite holding a valid work permit and pending visa application.

Cruz Gamez recounted being stopped during a traffic stop and subsequently detained by immigration authorities. He displayed his driver’s license and work permit but still ended up at an ICE facility in Portland, later transferred to a detention center in Tacoma, Washington. It was only with his lawyer’s help that he managed to avoid deportation.

Emotional about the impact on his family, Cruz Gamez conveyed, through a Spanish interpreter, that his family had been living in fear, preventing them from leaving home for weeks after his arrest.

During the proceedings, a federal lawyer expressed regret over how Cruz Gamez was treated and its repercussions on his family. Judge Kasbai remarked on the necessity for restraint from those in power, highlighting the principles of due process as fundamental to democracy and the Constitution, suggesting that we may be straying from these ideals.
