Young Woman Wins $2 Million in Unique Malpractice Case

A 22-year-old woman, who underwent a mastectomy at just 16, has been awarded $2 million in a landmark malpractice lawsuit, marking the first case of its kind brought forth by someone who has transitioned.

Fox Varian, the plaintiff, initiated legal action against a psychologist and a plastic surgeon in New York, claiming she regretted the surgery she had in 2019. According to her lawyers, the medical professionals involved misdiagnosed her gender dysphoria and provided unsuitable treatment.

On the defense side, they contended that Varian did not express any remorse until years later, only filing the lawsuit in 2023. They also pointed out that it was ultimately Varian’s own choice to adopt new pronouns, alter her name, wear a chest binder, and proceed with the mastectomy.

One of Varian’s attorneys suggested that the psychologist was heavily influencing Varian’s decisions, saying, “driving the train” and “planting ideas” in her mind.

Varian’s mother testified that she had initially opposed the surgery but agreed to it out of fear that her daughter might take her own life if she did not comply. She insisted that Varian’s therapist had amplified these worries.

During the trial, Varian recounted her feelings following the surgery. “I instantly felt this was wrong, that it couldn’t possibly be true,” she expressed. She described long-term physical sensations of pain, comparing it to “a burning hot… tearing sensation in my chest.”

“It’s unfortunate. I felt a profound sense of shame,” she added. “Coming to terms with the fact that your body is permanently altered is really tough.”

The six-member jury found that the doctors failed to follow crucial procedure guidelines and did not effectively communicate about Varian’s treatment plan. The jury determined that these oversights represented a clear “departure from the standard of care.” As a result, they awarded Varian $1.6 million for past and future pain and suffering and $400,000 for anticipated medical expenses.

Varian’s attorney initially sought $8 million in damages.

Notably, the case did not challenge whether such surgeries are appropriate for minors. Instead, the focus was on whether the medical professionals took the necessary steps to ensure a proper diagnosis and treatment for Varian.

According to reports, this case could potentially open the floodgates for many others. Benjamin Ryan, an independent journalist who attended the trial, noted that 28 similar cases had been filed so far, and Varian was the first to achieve a verdict.

Elon Musk reacted to Varian’s win, asserting, “There will be thousands of trials concerning children harmed by unscrupulous doctors,” comparing the situation to historical atrocities committed by infamous figures.
