Florida man beat transgender woman to death and ‘defiled’ the body a week after being released on probation, police say

On Tuesday, the body of 37-year-old Andreas Dorias Dos Passos was discovered near the Miami City Ballet.

Miami Beach police said they had obtained surveillance footage that shows a man hitting Dos Passos with a metal pipe as she slept near the entrance to the ballet venue.

Police said Dos Passos was found with lacerations to his head and face, a stab wound to his chest and a wooden stick stuck in his nostril. One of the sticks was sticking out of his eye.

The video reportedly shows the man throwing the metal pipe into a trash can and walking away. Police said they took fingerprints from the pipe and were able to identify the suspect, 53-year-old Gregory Fitzgerald Gibert.

Police said there were blood stains on his shoes and shorts when he was found.

The man was arrested and initially charged with second-degree murder, but a judge upgraded the charge to first-degree murder.

Miami-Dade Judge Mindy Glaser said Thursday: “I have had the opportunity to review the arrest affidavit, and it seems to me that this should be first-degree murder, not second-degree murder.” Ta. The arrest affidavit alleges that he struck the victim around the head and face with a metal pipe, then did other things to desecrate the victim’s body after she died. ”

The judge appointed Gibert a public defender but denied him bail.

Records show the suspect had just been released from prison a week before he allegedly killed Dos Passos.

Gibert was held on suspicion of armed robbery and aggravated assault, but was released after being given a four-year suspended sentence. WTVJ-TV reported that Miami-Dade prosecutors had asked for a 10-year prison sentence for Gilbert, but because the case was weak, he was released shortly after he agreed to plead guilty.

Dos Passos began identifying as a woman in October 2023, according to the indictment.

A Miami Beach Police Department spokeswoman said there was no indication Gibert killed Dos Passos because of gender bias.

“There is no evidence to suggest that this was a hate crime. The evidence does not suggest that the defendant targeted the victim on the basis of sexual orientation or gender,” Christopher Beth said. Ta.

“What we know is that the perpetrator is a very violent person and should not have come to our city,” he added.

The victim’s stepfather said Dos Passos had suffered from mental illness in recent years.

“I think the system failed her,” he said through tears. “At this moment, I feel like I’ve let her down too.”
