Florida Attorney General Seeks Supreme Court Intervention
On Monday, Florida Attorney General James Usmieer is asking the Supreme Court to permit the state to enforce Senate Bill 4C. This legislation aims to target illegal immigrants and criminalize their re-entry into Florida. Earlier this year, a federal judge in Miami prevented the law from being implemented, and a subsequent appeal to the 11th Circuit Court was also denied, which has led Usmieer to seek urgent relief from the Supreme Court.
In his appeal, Usmieer criticized the federal injunction as damaging to both state and national interests. He argued that illegal immigration is creating disorder within Florida. Usmieer’s office emphasized that, without immediate intervention from the Supreme Court, the state would be burdened for years as it confronts the ongoing issues linked to illegal immigration through lower courts.
The attorney general’s request follows a ruling earlier in the year where U.S. District Judge Kathleen Williams prohibited Florida from enforcing certain law enforcement actions. Usmieer is pressing the Supreme Court to overturn this injunction, suggesting the continued illegal immigration crises needs urgent attention. He claims that, without action, Florida residents will face prolonged legal challenges that fail to address the immediate problems posed by illegal immigrants.
Judge Williams had dismissed arguments presented by Usmieer that the law conflicted with federal regulations. In an exceptional move, she initiated proceedings against Usmieer this month for allegedly violating her injunction by allowing police to make arrests under the law.
Usmieer contends that the law is essential to protect Florida from the repercussions of illegal immigration, arguing it addresses issues such as human trafficking and the influx of fraudulent immigration claims. The timeline for when or if the Supreme Court will address his request remains uncertain, yet it coincides with the court’s review of six other emergency applications related to the Trump administration.
