In light of ongoing riots and unrest in Los Angeles and several major U.S. cities, retired FBI agents are warning that serious allegations could soon emerge against those causing chaos. Retired FBI special agent Jason Pack indicated that federal authorities might categorize violent acts during protests as domestic terrorism, if there’s evidence suggesting intent to threaten individuals or alter government policy through force.

“Federal law outlines domestic terrorism, but there aren’t specific charges labelled as such,” Pack clarified. A spokesperson from the Justice Department stated that “nothing is off the table” concerning potential accusations.

Pack mentioned that prosecutors typically rely on existing laws to pursue charges like arson or assault on federal employees. He emphasized that peaceful demonstrators exercising their First Amendment rights face no threat of terrorism allegations unless their activities escalate into violence driven by ideological beliefs. He noted, “When violent crimes occur with the intent to intimidate or advocate a political agenda, it may be treated as domestic terrorism.”

John Yu, a former Associate Deputy Attorney General and law professor, mentioned that the DOJ has ample grounds to pursue those obstructing federal justice. Pack reiterated that this applies mainly to those engaging in or planning violence, distinct from non-violent protesters.

He commented on the organized nature of some anarchistic groups involved in the violence, stressing that these individuals appear to execute planned operations during protests, targeting law enforcement and government entities. He described the tactics used as strategic, indicating these groups infiltrate peaceful protests with the aim of inciting violence.

Amid this turmoil, Senator Tom Cotton has introduced legislation aimed at implementing harsher penalties for violent protesters, particularly against federal agents. He expressed that a mob attacking immigration officers should face the full brunt of the law, declaring that such behavior would not be tolerated.

As violence continues to escalate, authorities have made numerous arrests, vehicles have been set ablaze, and tensions are high. LA County District Attorney Nathan Hochman warned that those exploiting protests for criminal acts would be held accountable. Meanwhile, President Trump has faced criticism from some Democrats for deploying U.S. Marines to assist law enforcement in restoring order in Los Angeles.

In statements made to Fox News, Cotton argued that the actions of protesters themselves, rather than federal law enforcement efforts, were the provocative factor in these situations. He asserted that enforcing laws is not provocative, highlighting the issues surrounding illegal immigration and the involvement of professional agitators amidst peaceful movements.
