From Advocate to Candidate: What Remains Unknown About Emil Bove

Emile Bove has stepped up to defend President Trump against significant abuses within the criminal justice system. This includes Trump’s legal battles surrounding the contentious 2020 election, prosecutions related to business records in New York, and issues stemming from the appointment of special advisor Jack Smith to investigate alleged election interference by the president.

Bove has shown commitment to his principles, declaring before the Senate Judiciary Committee that he’s “not afraid to make difficult decisions.” He isn’t someone who simply follows orders. He has repeatedly taken an oath to support the U.S. Constitution, which I think really matters.

However, despite his evident bravery, Bove’s nomination to the U.S. Court of Appeals for the Third Circuit is facing scrutiny—with votes pending from all Senators. Critics, including Trump’s opponents, have raised concerns about possible misconduct in legal dealings and more than 75 former state judges opposing his nomination, arguing that he disregards legal standards.

On the flip side, some reports present a different picture. Trump’s defense attorney, Christopher Kise, describes Bove as “exceptionally intelligent and respectful of differing viewpoints.”

As seen with the recent unfair legal actions against the president, there’s a pressing need for a federal judge focused on the proper legal processes rather than pursuing personal political agendas.

AFA Action’s Judicial Renewal Center is hopeful that Bove will be rated as a “confirm” or “confirm priority” nominee, supporting his nomination in the process. Bove’s history shows he can confront power abuses, making him a valuable asset for the federal judiciary. Still, the past 50 years of unsuccessful Republican judicial appointments remind us to thoroughly evaluate all judicial candidates. What concerns me isn’t just the information available about Bove, but what’s notably missing from his record.

When assessing judicial candidates, it’s not only about their courage but also their positions on various issues, such as faith, public service, religious freedom, and more. Interestingly, Bove’s record doesn’t reveal much on key issues important to social conservatives. In contrast, President Trump’s candidate for the U.S. District Court for the Eastern District of Missouri, Josh Divine, boasts significant information in related areas. Divine’s record also shows a clear stance on these important matters, which makes it easier for us to see how he would operate on the bench.

Sadly, social conservatives have had their share of disappointing judicial nominations. Justice Neil Gorsuch’s sometimes troubling record, particularly concerning the 2020 opinion in Bostock, which expanded rights under the Civil Rights Act of 1964, serves as a cautionary tale.

I sincerely wish I could convey that Emil Bove has a solid record indicating he won’t legislate from the bench in favor of more liberal policies. Unfortunately, that’s not something I can firmly state. Yet, he does seem to possess a tangible courage, and I genuinely hope he, along with President Trump and our federal courts, receives our most ardent support.
