Senator Roger Marshall (R-KS) introduced A bill was introduced Wednesday that would block the Department of Health and Human Services (HHS) from implementing the policy. rule Parents who disagree with gender ideology may then be unable to raise their children.
The bill, called the Religious Freedom Protection for Foster Families Act, would affirm the child’s gender identity and provide “necessary services to society” for minors who identify as LGBT. It prohibits HHS rules that require health care providers to provide consent. Support their health and well-being. ” The bill is co-sponsored by Sen. Marsha Blackburn (R-Tenn.) and co-sponsored in the House by Rep. Josh Brechen (R-Okla.).
“All children in foster care, regardless of their sexual orientation or gender identity, have the right to be placed in safe and appropriate facilities,” Marshall said in a statement. “This extreme proposal by HHS perversely discriminates against faith-based families and loving foster parents in an attempt to impose radical gender ideology and pronominal politics on faith-based families.”
The bill would prevent HHS from finalizing regulations or implementing and enforcing regulations and other similar measures.
“This rule will have a particularly devastating impact on rural areas across the country, where there are fewer foster care providers than children in need of safe homes,” Marshall added. “This administration needs to stay out of politics and help as many children as possible who need love, care and support.”

Mr. Marshall also led several other councilors. send A January 2024 letter to Health Department Secretary Xavier Becerra lists several concerns Republicans have about the proposed rule.
Lawmakers said they were concerned the rule would prevent Christian Child Care Services from working with the state to provide homes for children.
“If passed, this proposal would place additional strain on the child welfare system and undermine the state’s ability to provide safe, stable, and loving homes for our most vulnerable children,” the letter said. It’s dark.
“All children in foster care, regardless of sexual orientation or gender identity, have the right to be placed in a safe and appropriate place. “However, this proposal would go beyond statutory requirements and force states to adopt extreme gender ideologies in their placement decisions,” the letter continues. “Congress intentionally gave states the power to make these decisions, but HHS usurped that power and replaced state judgment with its own woke ideology.”
Lawmakers also warned that the proposed rules could be inconsistent. Some states have outlawed sex-change drugs and amputations for minors.
“These procedures can cause irreversible harm to children, many of whom lack consistent parental guidance and the physiology necessary to make informed decisions about such outcomes. “States should not be penalized for acting to protect their children,” the letter reads.
