Accusations Against New York Attorney General Letitia James

Letitia James, the Attorney General of New York, faces allegations of “unlawful and dishonest conduct” according to claims made by her own attorney. These allegations correlate with criminal charges that arose after federal mortgage fraud charges were dismissed by a judge appointed by President Clinton.

The Center for the Advancement of American Security (CASA) has formally requested an investigation into James from the state Attorney Grievance Commission. This was reported on Friday.

Curtis Schube, the director of research and policy for CASA, highlighted key elements such as fraud, misrepresentation, and trustworthiness, which the Rules of Professional Conduct weigh heavily when deciding on disciplinary actions against attorneys. In a four-page complaint, Schube emphasized the severity of the allegations and called for the Bar Council to take immediate action regarding the mortgage issues facing James. If the claims hold validity, he suggested that appropriate disciplinary measures, potentially including disbarment, should be considered.

In October, prosecutors alleged that James sought more favorable loan terms by misrepresenting her property usage. She had consulted with a bank about the home she purchased in Norfolk, Virginia, asserting that she would use it as a second home. However, she later rented it out to family members.

On November 24, a District Judge named Cameron Curry dismissed the federal charges against James, which were filed by the U.S. Department of Justice, including accusations of bank fraud related to a $109,000 mortgage. The judge found that the special prosecutor, Lindsey Harrigan, lacked the legal authority to bring these charges without necessary congressional approval.

Additionally, Judge Curry dismissed another charge concerning false statements to Congress related to alleged misconduct involving former FBI Director James Comey, also presented by Harrigan.

CASA is expected to face scrutiny later in October for submitting complaints against Comey in both New York and Virginia, where he is licensed to practice law. The bar associations in these states also possess the power to revoke lawyers’ licenses.

While some have labeled CASA as “conservative” or “right-leaning,” the organization identifies itself as “bipartisan,” aiming to enhance the “safety and security” of Americans.

White House Press Secretary Caroline Levitt remarked that the Justice Department would likely respond to the judge’s ruling against Harrigan. This ruling was pivotal in the dismissal of charges before they could be thoroughly examined in court.

Levitt expressed confidence in Harrigan’s qualifications for her role and suggested that the Department of Justice would soon pursue an appeal regarding the matter.
