DHS Confirms Guilty Pleas in Human Smuggling Operation Linked to Fatal Crash
The Department of Homeland Security (DHS) announced on Wednesday that two Guatemalans have confessed to their involvement in a significant human smuggling scheme that resulted in a tragic tractor-trailer accident in Mexico in 2021. This crash claimed the lives of 56 individuals, including children, and left over 100 others injured.
Josefa Kino Canil de Zavala and Alberto Marcario Titich have both pleaded guilty to conspiracy charges related to the illegal transport of immigrants into the U.S., which endangered lives and ultimately resulted in death. According to DHS officials, these two are part of a group of five Guatemalans extradited to the U.S. for prosecution in 2025, with a sixth suspected accomplice being arrested in Texas.
Federal authorities have indicated that this incident underscores the consequences of open border policies.
“This is another example of how President Biden’s policies have led to a humanitarian crisis, enabling smugglers to profit from the tragedies faced by illegal immigrants,” said Lauren Biss, acting DHS assistant secretary. “Thanks to the diligent efforts of ICE, these criminals are being held accountable and will face justice soon.”
According to prosecutors, the crash on December 9, 2021, was orchestrated by a well-organized smuggling network that treated human lives as mere commodities.
Migrants were recruited in Guatemala, with their funds pooled together. They were crammed into livestock trucks and trailers to embark on the dangerous journey northward to the U.S. border.
The fatal incident occurred just beyond the Guatemala-Mexico border.
“This tragedy highlights the complete disregard smugglers have for the lives of the individuals they transport, even amidst significant risks, like extreme heat and hazardous travel conditions,” stated Assistant Attorney General A. Theisen Duva from the Justice Department’s Criminal Division.
John G.E. Mark, an assistant U.S. attorney for the Southern District of Texas, pointed out the ruthless nature of the operation, mentioning that the smugglers even provided children with “scripts” to mislead law enforcement if caught.
Joint Task Force Alpha, a specialized collaboration between the Department of Justice and the DHS aimed at dismantling cartels and transnational crime, led the successful prosecution. So far, the task force has resulted in over 458 arrests and 408 convictions involving key players in illegal immigrant smuggling operations in the United States.
