Alina Habah Stays as Acting U.S. Lawyer for New Jersey

On Thursday, Alina Habah made it clear that she plans to continue in her temporary position as a U.S. lawyer for New Jersey. A federal judge recently decided to extend her term, and Habah stated she wouldn’t back down under pressure.

Habah, who previously worked as a private attorney for Donald Trump, shared in an online statement her current title as “acting” U.S. lawyer. She expressed her dedication, saying, “Donald J. Trump is the 47th President. Pam Bondy is the Attorney General. I am currently a United States lawyer for the New Jersey area. I will not put any pressure on you. I will not answer politics. This is a fight for justice. And I will be in everything.”

A spokesperson from the Department of Justice confirmed that Habah holds the role of “acting” U.S. lawyer, distinctly different from the previous “tentative” position she held.

Interestingly, the situation surrounding Habah’s role involves complex federal vacancy laws. These laws allowed the New Jersey District Court to decide on extending Habah’s 120-day term or appointing a replacement. Initially, they opted for a replacement—Desiree Grace, who is Habah’s No. 2. However, Attorney General Pam Bondy acted swiftly to terminate Grace’s appointment, leaving some uncertainty about who will fill the position moving forward.

While the Department of Justice noted Habah’s term as an “interim” U.S. lawyer is set to expire this Friday, it raises the question: what will happen next?
