Harvard Takes Legal Action Against Trump Administration for Preventing Foreign Student Enrollment

New Delhi: Harvard University announced on Friday that it is taking legal action against the U.S. government over its decision to revoke the institution’s ability to enroll international students—a development that intensifies the ongoing conflict between President Donald Trump and the prestigious university.

In a statement, Dr. Alan M. Gerber from Harvard criticized the government’s actions as “illegal and unjust,” confirming that the university has submitted a legal petition seeking a restraining order to address this issue.

Gerber stated, “This illegal and unfair behavior threatens the futures of thousands of students and researchers at Harvard, and it serves as a warning to many others across the nation who wish to come to America for education and to chase their dreams.” He added, “We have filed a complaint and will pursue a temporary restraining order. Our commitment is to support students and academics in seeking legal remedies. The Harvard International Office will continue to provide updates as new information arises.”

This lawsuit follows the Trump administration’s recent decision to cancel Harvard’s rights under the federal Student and Exchange Visitors Program (SEVP), which allows for the enrollment of international students. According to university statistics, over 27% of Harvard’s student body comprised international students during the 2024-2025 academic year.

Last month, Trump had hinted at potential such actions should the university fail to comply with government expectations regarding political oversight. The administration indicated that Harvard could regain its status if it met specific conditions within 72 hours.

According to Gerber, “The government claims its disruptive measures stem from Harvard’s inability to provide requested information to the U.S. Department of Homeland Security, but in reality, Harvard has complied with all legal obligations.”

Harvard also mentioned that it was certified to enroll international students on F-1 visas, as stated in a lawsuit filed in the U.S. District Court for the District of Massachusetts.

Gerber expressed concern, saying, “The government abruptly revoked its certification without any due process or explanation, causing immediate and severe consequences for Harvard and over 7,000 visa holders. This action blatantly violates the First Amendment, Due Process Clauses, and the Administrative Procedure Act.”

American universities have denounced this revocation as “a clear act of retaliation” against Harvard for exercising its First Amendment rights. They argue that it reflects an attempt to control the institution’s governance, curriculum, and the ideologies of its faculty and students.

Harvard noted that this recent action could eliminate a significant portion of international students who have significantly contributed to the university and its mission.
