Harvey Weinstein May Face New Indictment As More Accusers Come Forward

Harvey Weinstein may face new sexual assault charges as more victims begin to come forward.

During a court hearing Wednesday, Assistant District Attorney Nicole Blumberg said more women are coming forward with additional accusations against Weinstein.

Judge Curtis asked Blumberg if there was a possibility that prosecutors would file new charges, to which he replied, “Yes, your Honor.”

Prosecutors said the court could receive an update by the end of June. At a previous hearing, Weinstein’s retrial, in which his conviction was overturned, was tentatively set for sometime after Labor Day, but no exact date had been set.

Weinstein’s 2020 rape conviction was overturned by a New York appeals court, which also ordered a new trial in a #MeToo-era reversal of the case.

The court ruled 4-3 that the judge in Weinstein’s case allowed prosecutors to call as witnesses women who say they were abused by the showbiz mogul, even though they have no connection to the allegations against Weinstein.

Weinstein was convicted in February 2020 of forcing oral sex on television and film production assistant Mimi Haley in 2006 and third-degree rape of hairstylist Jessica Mann in 2013, and was originally sentenced to 23 years in prison.

However, the film producer was found not guilty of first-degree rape and two counts of predatory assault. Weinstein has denied ever engaging in non-consensual sex acts.

The defense argued that the defendant should not be extradited at this time, citing his “very serious health issues” and the need to prepare for a retrial.

“Our biggest concern in this case is that Mr. Weinstein will be able to come to New York and prepare for trial and receive the medical care he needs,” Diana Fabi Samson told reporters at a post-trial news conference. “And we are concerned that traveling will impact his health issues.”

“He has very serious health issues and I think it’s also worth noting that he’s been in the hospital since the day he was incarcerated,” she later said.

California is seeking Weinstein’s extradition to serve his 16-year prison sentence.

Weinstein was convicted in California on charges unrelated to the conviction overturned in New York, but served less than a year of his 16-year sentence.

Weinstein was convicted in California after a woman known as “Jane Doe 1” accused him of forced oral sex, rape and other sexual misconduct. His lawyers have vowed to appeal the verdict.
