HHS Investigates School for Unauthorized Vaccination of Child

The Health and Human Services (HHS) department’s recent investigations into a school that vaccinated a child without the parent’s consent might affect parents’ rights concerning their children’s health care decisions, particularly around gender transitioning.

HHS initiated its inquiry on Wednesday, targeting a Midwestern school involved in administering a vaccine without parental approval.

A letter issued by HHS emphasized to healthcare providers that the Health Insurance Portability and Accountability Act (HIPAA) mandates them to allow parents access to their children’s health information. Furthermore, the Health Resources and Services Administration has been instructed to implement a grant requirement ensuring federally funded health centers adhere to parental rights laws.

One HHS official noted that these measures, aimed at reinforcing parental authority over health care decisions, could have broader implications beyond just vaccinations.

This investigation signals to healthcare providers that HHS will enforce laws concerning parental rights, particularly if there are attempts to pursue transgender treatments for children without parents’ knowledge. “The HIPAA Privacy Rule is explicit: providers are required to share health information about minors with their parents,” the official remarked. They suggested that anyone intentionally withholding information may be trying to conceal transitioning procedures or vaccinations from parents.

The official added, “Today’s letter serves as a clear warning that HHS will not tolerate HIPAA violations.”

Typically, under HIPAA, parents can access their child’s medical records and must generally consent to any medical procedures performed on minors. However, there are states, like Maine, that allow minors to begin gender transitioning without parental approval. For instance, minors as young as 16 in Maine can initiate hormone therapy without needing their parents to sign off.

The HHS Office of Civil Rights reiterated the importance of parental access to children’s protected health information as per HIPAA guidelines.

It’s significant that HHS is scrutinizing a school for infringing on parental rights in health care, as many schools have historically violated such laws, according to Matt Bowman, a senior counsel at Alliance Defending Freedom and former HHS deputy counsel.

Bowman highlighted the growing trend where schools accept federal funding to provide medical services and sometimes overstep parental authority in ways that might jeopardize children with risky gender transition protocols. “Schools need to be mindful that they are bound by federal laws that safeguard parental rights when they engage in medical practices,” he noted.

For instance, a health center at San Lorenzo High School in California offers “gender-affirming hormone therapy and medical transitioning services,” which include various transitioning aids and counseling without parental acknowledgment.

Additionally, reports have surfaced indicating that schools in Seattle provide access to “gender-affirming medications and procedures” without informing parents.

HHS has clarified that no minor should receive any medical services at federally funded centers without parental consent, in alignment with existing state and federal laws.

The letter emphasizes that parents hold the rights concerning their children’s health information and can assert those rights effectively.

The Office of Civil Rights is also planning compliance reviews across several large health care providers to ensure that access to children’s health information is provided in a timely manner to parents.

Bowman expressed confidence that HHS’s investigation conveys a strong message about the importance of respecting parental and religious rights in the health care sector. “We appreciate the clear stance HHS is taking and the implications of their message to healthcare providers,” he added.
