House Subpoenas 15 Biden Agencies on Assistance to Local Election Officials

House Administration Committee Chairman Brian Steil (R-Wis.) said Thursday he had subpoenaed the Biden administration for documents related to President Joe Biden’s March 2021 executive order directing federal agencies to work with local election officials, calling the order an attempt to “tip the tide of battle for 2024.”

Steil posted on Thursday X:

Biden’s executive order on voting access is the latest plan shaping his administration’s course into 2024.

Because Congress has not appropriated taxpayer funds for partisan activity, I have subpoenaed the Biden Administration for documents related to Executive Order 14019.

Steele is Subpoena Fifteen Cabinet members discussed documents related to a presidential order titled “Executive Order on Promoting Access to Voting,” which directs federal agencies to use their resources to promote access to voting.

“Evidence already makes clear that the executive order coordinates federal agents and partisan allies in an effort to register voters ahead of the 2024 elections,” the committee, which began investigating the order shortly after it was announced, said. The committee said Steele first requested the documents on May 15 but has not received any response to date.

Elections are partisan, but the administration of our elections should never be partisan. Allowing Biden Administration federal agents to flood election administration sites threatens the integrity of our elections and undermines confidence among the American people.

This executive order is another attempt by the Biden Administration to shift the balance of power heading into 2024. Congress has not appropriated taxpayer funds for partisan activities, and I will continue to work for transparency and accountability regarding this Administration’s latest plans.

The order states that “executive departments and agencies must work with State, local, tribal, and territorial election authorities to protect and promote the exercise of the right to vote, eliminate discrimination and other barriers to voting, and expand access to voter registration and accurate election information.”

Steele sent subpoenas to the secretaries of the Departments of Transportation, Agriculture, Interior, Treasury, State, Health and Human Services, Energy, Education, Defense, Commerce, Justice, Office of Management and Budget, Housing and Urban Development, and Labor.

Steele wrote to the department secretaries:

The Committee is concerned about the implementation of Executive Order 14019, particularly its consistency with the provisions of the National Voter Registration Act of 1993 (NRA). Congress has delegated certain functions and missions to Federal agencies, which Federal agencies are required by law to comply with. Congress’ delegation of authority to HUD does not include the use of funds or resources to provide voter registration materials to the American people.

Additionally, Executive Order 14019 requires all federal agencies to submit strategic plans outlining how the agency will promote voter registration and voter participation. In the past few months, some agencies have taken steps that were likely outlined in their strategic plans; examples include the Department of Education’s new federal work-study requirements and the Small Business Administration’s entry into a voter registration compact with the State of Michigan. Both of these actions and those of other agencies raise significant questions and concerns, some of which could be addressed by having access to the strategic plans the agencies have prepared.

The committee is considering legislation to repeal Executive Order 14019 and require agencies to submit their strategic plans to Congress.

According to Fox News, report Senate Republicans, led by Sen. Bill Hagerty (R-Tenn.), also have requested information about the order, according to the subpoena. They say they asked the Biden administration for answers in November but were denied.

A lawsuit challenging the order was filed in April, arguing that it targeted key demographics to benefit the president’s party and his own reelection, according to Fox News.

“The Biden campaign is using its power and resources to target welfare recipients with a federally funded get-out-the-vote effort,” Tarren Bragdon, president and CEO of the Government Accountability Foundation, which filed the amicus brief, told the outlet.

“If their plan is fully implemented, it could sway the outcome of the election,” he said.
