Huge victory for Christian cake baker after more than a decade of LGBTQ harassment in court

Christian cake baker finally lost After more than a decade in court, he claimed legal harassment from the LGBTQ+ movement.

Jack Phillips was sued in 2012 for refusing to make a cake for a same-sex couple at his Masterpiece Cake Shop in Colorado, and later for refusing to make a cake to celebrate transgender transition. . Lawyers from the Alliance Defending Freedom have represented Phillips for 12 years.

“Enough is enough. Jack has been dragged through the courts for over a decade. It's time to leave him alone.”

The Colorado Supreme Court on Tuesday dismissed a second lawsuit, saying the lawyers who filed the suit did not follow proper procedures. Phillips won his first lawsuit in 2018 after a court found that officials acted in a hostile manner and contrary to his faith.

Neither legal victory established Phillips' constitutional right to free speech as a basis for termination.

“Enough is enough. Jack has been dragged through the courts for more than a decade. It's time to leave him alone,” said ADF Senior Counsel Jake Warner.

“Freedom of speech is for everyone,” he added. “In this lawsuit, the attorney asked Jack to create a custom cake to celebrate and symbolize his transition from man to woman. The cake clearly expressed a message, and Jack wanted to share that message with anyone. The government cannot punish Jack for refusing to express his message. The First Amendment protects that decision.

ADF said Phillips' lawyer asked him to decorate a cake with a picture of a devil smoking marijuana to “correct” his thinking.

“Phillips serves people from all backgrounds. Like many artists, he chose to create custom cakes based on themes such as: what they will express, who ” read the ADF statement.
