Hunter Biden’s lawyers have granted a motion to dismiss criminal charges against Biden in California while refuting a federal judge’s threat to sanction them for making “false statements.”
in Submitted on Sunday After Judge Mark Scarce of the U.S. District Court for the Central District of California wrote a letter saying Biden’s legal team had falsely claimed that U.S. Attorney David Weiss had not prosecuted the president’s son until he was appointed special counsel, Biden’s legal team said they had “never attempted to mislead the Court.”
“The defense, perhaps clumsily, used the word ‘charges’ to refer to the current charges raised in the indictment against Mr. Biden, not to the absence of any charges at all,” Biden’s lawyers wrote. “Context is important here.”
“As United States Attorney, he had years of time to bring any charges he deemed justifiable, but he did not do so until he obtained the special prosecutor title he sought,” the motion in question stated.
Scalci wrote in his order last week that Weiss filed the initial complaint against Biden as a federal prosecutor and before he was appointed special counsel, accusing the lawyers of making false statements.
Biden’s lawyers said they would amend their motion to replace the word “accusation” in the disputed statements with “indictment,” but stressed that in context, the language was not misleading.
“But there is no basis to punish Biden’s personal lawyers.
“The use of that word was not misleading in the context of the two earlier complaints, which had been repeatedly presented before the Court,” the lawyers wrote.
This comes days after Scalci ordered the defense to “show cause why sanctions should not be imposed for the false statements made in the motion.”

He is accused of failing to pay at least $1.4 million in federal taxes between 2016 and 2019.
The nine felony and misdemeanor tax evasion charges also allege that he tried to avoid paying taxes by filing false tax returns in 2018 and used the money to fund a lavish lifestyle that included drugs and alcohol.
His lawyers also filed a motion asking a Delaware judge to dismiss criminal charges against him in a federal firearms case in which he was convicted last month.
Both motions cite U.S. District Judge Eileen Cannon, who dismissed a Florida lawsuit against former President Trump over classified documents and ruled that special counsel Jack Smith was not lawfully appointed.
