Illegal Accused of Raping Disabled Person Was Freed into U.S. by Biden’s DHS

An illegal immigrant accused of raping a severely mentally disabled Rhode Islander has been released into the United States by President Joe Biden’s Department of Homeland Security (DHS).

Rigberto Hoyos Alban, a 33-year-old illegal immigrant from Colombia, Crossed He was arrested at the U.S.-Mexico border near the Rio Grande Valley in Texas in November 2023. He was given a Notice to Appear (NTA) before a federal immigration judge and released into the U.S. interior.

In March, Hoyos Alban was arrested by Central Falls, Rhode Island police and charged with two counts of first-degree sexual assault, two counts of second-degree sexual assault and one count of felony assault of a mentally disabled person.

Following his arrest, Immigration and Customs Enforcement (ICE) agents filed a detention order against Hoyos-Alban, requesting that he be held in custody if he is released at any time from the Rhode Island Adult Correctional Facility.

Prison officials did not honor ICE’s detention order and instead released Hoyos-Alban, after which ICE agents arrested him in Cranston, Rhode Island on May 22.

“Rigberto Hoyos Alban has been charged with four counts of sexual assault and one count of assault on a severely intellectually disabled person,” ICE official Todd Lyons said. “This is not the type of person we want walking the streets of our New England neighborhoods.”

Hoyos Alban remains in ICE custody awaiting deportation.
