An illegal alien released into the United States by President Joe Biden's Department of Homeland Security (DHS) is facing charges including kidnapping and attempted rape in his sanctuary state of Massachusetts.
Emilio Jose Pena-Casilla, 46, an illegal immigrant from the Dominican Republic, was the first. crossed The U.S.-Mexico border near Eagle Pass, Texas, January 9, 2023. Pena-Casilla was enrolled in the Alternatives to Detention (ATD) program and entered deportation proceedings.
Immigration and Customs Enforcement (ICE) subsequently released Peña-Casilla to the interior of the United States on his own recognizance. Pena Casilla exited the ATD program on February 16, 2023.
On July 15, Pena-Casilla was charged in a Boston, Massachusetts court with attempted rape of a person over 14 years of age, kidnapping, indecent assault and battery, and intimidation of a witness.
After his arraignment, ICE agents released Pena-Casilla into custody at the Nashua Street Jail operated by the Suffolk County Sheriff's Office. The detainees were ignored and Pena-Casilla was released on bail.
Pena-Casilla was indicted on the charges in Suffolk County on Sept. 11. On December 17, ICE officers arrested Mr. Pena-Casilla, and he remains in custody until he is deported.
