Officials said Guimaras Silva legally returned to the United States on September 3, 2017, violated the terms of his legal approval.

ICE then launched immigrant detention against Guimarès Silva with the Middlesex County Correctional Hospital on February 16, 2024, following arrests by local authorities.
The district court found Guimares-Silva guilty of two counts of assault and battery. The court then sentenced Guimares to a one-year prison sentence, but suspended everything except for the 90-day period.
Officials said the court subsequently released Guimarès Silva from state custody, ignoring ice immigrant detainees.
