A 28-year-old “runaway” immigrant was arrested and charged with rape after being released from state court, despite having a violent criminal history.
U.S. Immigration and Customs Enforcement (ICE) announced the arrest of Jorge Luis Castro Alvarado in a statement from its field office in Boston, Massachusetts on Friday.
He was arrested on August 1 in Lynn, Massachusetts.
The Boston office of ICE's Enforcement and Removal Operations (ERO) said the migrant “is suspected of illegally entering the United States and victimizing residents here before traveling to Massachusetts.”
ICE said the Guatemalan migrants entered the U.S. without inspection, admissibility or parole.
Authorities have yet to determine exactly when and where Castro-Alvarado first entered U.S. territory.
In February, ERO Boston filed for an immigration detention order against Castro-Alvarado after he was arrested on suspicion of assault and battery on a family member or cohabitant.
The immigrant was later convicted of assault and sentenced to 18 months in prison.
The Lynn District Court later reduced the prison sentence to six months.
According to ICE, Castro-Alvarado was indicted in April in Essex County Superior Court on two counts of rape and indecent assault on a person over the age of 14.
The judge ignored ICE's detention orders and released the suspects on bail without notifying immigration authorities.
“The Essex County Superior Court released Castro on bail without notifying ERO Boston, even though an immigration detention order was in effect,” ICE reported. “The court imposed several conditions on Castro's bail, including requiring him to undergo GPS electronic monitoring prior to his release into society.”
“Castro posed a significant threat to members of our community,” Todd M. Lyons, director of ERO's Boston field office, said in a statement. “ERO Boston will continue to prioritize public safety by capturing and eliminating non-citizen threats to our New England neighborhoods.”
Fox News Digital reached out to the Essex County Superior Court for comment but did not receive a response.
