The International Court of Justice (ICJ), the UN’s judicial body that deals with conflicts between states, on Friday refused to block Israel’s military operation in Rafah, Gaza Strip, against the Palestinian terrorist group Hamas.
South Africa, which is pursuing a separate case against Israel for alleged “genocide” in the Gaza Strip, filed an emergency application with the ICJ on Monday, hours after Israel rescued two hostages from Rafah. South Africa complained of “assault” but the hostages ignored them.
In response, the ICJ referred to last month’s interim ruling on “genocide” and reminded Israel to abide by its obligations. (The ICJ did not prevent Israel from taking military action in Gaza, but it did require Israel to submit a report.)
ICJ Said Friday:
The tribunal noted that, as the UN Secretary-General stated, recent developments in the Gaza Strip, particularly in Rafah, “exponentially increase a situation that is already a humanitarian nightmare and has enormous regional consequences.” (Remarks to the General Assembly) Regarding priorities for 2024 (February 7, 2024))
This dangerous situation demands the immediate and effective implementation of the interim measures set out by the Court in its order of January 26, 2024. These interim measures apply to the entire Gaza Strip, including Rafah.
Suggestions for additional interim measures. The Court emphasizes that the State of Israel remains obliged to fully comply with its obligations under the Genocide Convention and its Decree, including ensuring the safety and security of Palestinians in the Gaza Strip.
Israel says it needs to attack Hamas in the Gaza Strip to eliminate the last four Hamas battalions, capture Hamas leaders and rescue the remaining approximately 130 Israeli hostages. There is.
Many countries, including the United States, have discouraged Israel from launching attacks on Hamas in Rafah. This is partly due to concerns about the number of Palestinian civilians who have fled there, and partly because some want to use Hamas’s presence in Gaza as leverage to coerce Israel. Acceptance of a Palestinian state as a condition for the release of hostages.
On Friday, reports surfaced that Egypt is building a walled enclosure near its border with Rafah in anticipation of an influx of up to 100,000 Palestinian refugees, a move that Egypt is reportedly building on its private border. It’s a sign that by evacuating people, Israel may be covertly helping to defeat Hamas.
Apart from this, the ICJ: set to hear testimony from 52 countries opposed to Israel’s presence in Judea and Samaria (West Bank) as part of a non-binding advisory opinion process launched through the United Nations in 2022, long before the war. .
