International Court States Countries Neglecting Climate Change Are Responsible for Harm

UN Court Rules on Climate Change Compensation

A top court within the United Nations determined on Wednesday that nations causing harm related to climate change are eligible for reparations from those who have not acted sufficiently to safeguard the climate.

The International Court of Justice (ICJ) in The Hague emphasized the importance of taking protective measures for the planet, based on various reports.

Legal repercussions arising from international torts could involve full compensation for the affected state, the court stated, as reported by France 24.

The ICJ noted that there must be “sufficient direct and specific causality” linking the tort to the injury.

“A state failing to implement adequate measures to protect the climate system may be committing an international tort,” the court expressed during the hearing.

According to France 24, the ICJ’s advisory opinion arose from a pivotal case concerning state responsibilities to confront climate change and the potential consequences of inaction, labeling it an “urgent and existential” threat to humanity.

This opinion, which spans over 500 pages, might mark a significant shift in international climate law.

The case was initiated by Vanuatu, a Pacific Island nation, with backing from more than 130 countries due to its vulnerability to rising sea levels.

While the ruling is not legally binding, a report by CNN suggests that the court’s stance carries substantial weight, potentially bolstering climate negotiations and enhancing climate litigation globally.

However, critics from Breitbart News argue that the opinions lack enforcement power, allowing major polluters like China and India to overlook them. Additionally, the United States has not participated in mandatory ICJ jurisdiction since withdrawing in 1986.
