Intruder allegedly charges at Texas homeowner with screwdriver. But homeowner is armed with more lethal tool.

An intruder allegedly lunged at a Texas homeowner with a screwdriver Monday afternoon, but the homeowner had a gun and won the confrontation.

Sherman Police received a report of shots fired from a home in the 1300 block of East Ida Road around 5 p.m. KXII-TV reported.Sherman is about an hour and a half north of Dallas.

“The firing of the firearm appears to have been justified under state law,” the lieutenant added to the sheriff’s office.

Within five minutes of arriving, officers detained a man matching the description of the suspected intruder, according to the sheriff’s office.

Sherman Police Department Lt. Sam Boyle told KXII the suspect “was apprehended breaking into the homeowner’s shed behind the house.” [but] When the homeowner confronted the suspect, he allegedly lunged at him with a screwdriver, and the homeowner claims he fired the gun in self-defense.”

“Officers located the homeowner and detectives were called,” Boyle told police, adding that tools used in burglary were found at the scene.

“We found some evidence that supports the homeowner’s allegations, and we don’t see anything at this point that disproves his allegations,” Boley told KXII. “The firing of the gun appears to have been justified under state law,” he added.

Jose Mengivar was taken into custody less than a block from the scene and taken to a local hospital with a minor gunshot wound to the hand, KXII reported, and was arrested on suspicion of trespassing.

“Once we have solid facts and have received statements from those in custody, we will be consulting with the District Attorney’s Office,” Boyle added to the station.
