Israeli Victims of October 7 Attack File Charges Against Hamas at ICC

Families of Israeli hostages traveled to The Hague, Netherlands, on Wednesday to press charges against Hamas at the International Criminal Court (ICC), submitting a 1,000-page document on Hamas’ crimes since the October 7 terrorist attack.

Hundreds of people took part in a rally organized by the forum outside the courtroom as rain fell in the Dutch city, including the parents, siblings and children of the hostages, as well as those freed from Hamas captivity in November and others. The ICC is different from the International Court of Justice (ICJ). The latter, with Israel currently defending itself against charges of “genocide” by South Africa, is intended to resolve conflicts between nations. The former has jurisdiction to pursue violations of international law. Although Israel is not a signatory to the Rome Statute giving powers to the ICC and is not subject to its jurisdiction, the court’s jurisdiction could conceivably be extended to war crimes by non-state actors such as Hamas. .

The ICC has issued arrest warrants for Hamas leaders and financiers, restricting their ability to travel and using the international financial system to carry out terrorist activities against Israelis and others, as they have done despite the war. It may provide funding.
