Texas Man Fleeing to Italy After Pregnant Wife’s Murder

Texas criminal lawyer Dick DeGuerin, who has been in the profession for 60 years, is currently defending Lee Gilley. Gilley, 39, stands accused of murdering his pregnant wife, Christa Bauer Gilley, 38, in their Houston home back in October 2024.

The investigation revealed that Gilley removed his ankle monitor and fled to Italy in May, just weeks ahead of his trial. DeGuerin remarked, “In my extensive career, I’ve had clients skip bond before, but never like this.”

Since arriving in Italy, Gilley was captured by local authorities and has been detained in Turin. Over the summer, efforts to extradite him back to the U.S. were thwarted when Italian courts intervened.

DeGuerin explained, “The Italian courts will refuse extradition if the death penalty is a possibility, and Gilley is charged with capital murder. In Texas, the only two sentences for that are death or life without parole.”

In a recent development on September 18, prosecutors in Harris County decided to drop the death penalty following demands from Italian judges for written assurances regarding Gilley’s potential punishment.

DeGuerin expressed the concerns of the Italian courts, noting that there is a fear a judge could still inflict the death penalty, which they strictly oppose. He affirmed, “Only a jury has the authority to impose that.”

Interestingly, Gilley’s attorney highlighted that if there exists a chance of a life sentence without parole, Italy could deny extradition as well. The U.S. has until September 30 to answer Italy’s requests for further clarification, after which a status conference will be held regarding the extradition process.

At the heart of the matter is the assertion from Gilley’s defense that he is innocent of the charges against him. His next court appearance is scheduled for October 7.
