Jack Smith invokes Hur report in Trump classified documents case

Special Counsel Jack Smith cited Robert Hur’s report on President Biden’s handling of classified materials in court documents filed Monday in former President Trump’s federal secrets case.

Mr. Smith, like Mr. Hur, was an appointee of Attorney General Merrick Garland, who was chosen by Mr. Biden to head the Department of Justice, and said Mr. Trump’s violations were intentional, willful, and beyond his authority. It also included sharing confidential information with people who were not authorized to do so. Federal prosecutors say Trump’s intentional detention is why his property in Mar-a-Lago, Florida, had to be searched by the FBI, and that sensitive materials were found in various locations on the property. It is claimed that a box containing the was discovered.

Meanwhile, Biden’s team said it fully cooperated with investigators when classified documents dating back to his time as vice president and senator were discovered at his home in Delaware and his former office in Washington.

Mr. Smith argued in his filing that Mr. Trump’s comparison of the two cases failed to identify anyone who faced similar legal predicaments.

“Defendants have not identified anyone who engaged in deliberate and deceptive criminal conduct substantially similar to this and was not indicted. Nor could they,” Smith wrote in the filing. “Indeed, the comparators they rely on are easily distinguishable.”
