Jackson: Supreme Court 'has to be prepared to respond' to election

Supreme Court Justice Ketanji Brown Jackson said in a new interview that she is “as ready as anyone” for the possibility that this year's presidential election will be heard by the Supreme Court.

“I think there are legal issues that arise out of the political process,” Jackson said in an interview with CBS' Norah O'Donnell.

“The Supreme Court therefore needs to be prepared to act if necessary,” she added.

Jackson's rare interview comes as she prepares to release her autobiography, “Lovely One,” next week. Excerpts from the interview will air on the “CBS Evening News” on Tuesday, before the full interview airs this weekend on “CBS News Sunday Morning,” the network said.

“Are you prepared for the possibility that this election could go to the Supreme Court?” O'Donnell asked the justices.

“I'm more prepared than anybody,” Jackson replied, then laughed. “Let me ask you this: Are you prepared for all the news cycles that you're going to get as a result of this election?”

O'Donnell responded, “Hmm, no.”

The interview came as Vice President Harris currently leads former President Trump by four percentage points, 49.5% to 45.5%, according to polling data compiled by The Hill/Decision Desk headquarters.

Jackson, who will be nominated by President Biden to serve on the Supreme Court in 2022, was also asked about his fierce dissent from Supreme Court decisions that granted broad criminal immunity to former presidents and handed former President Trump a major legal victory in his fight against prosecution.

“My concern was that we have a criminal justice system that generally treats everyone equally, but in certain circumstances, it seems to give individuals immunity,” Jackson told CBS.
