Judge Orders Restoration of Immigration Program

A judge appointed by Biden has ruled that the Trump administration must reinstate a program that supports taxpayer-funded legal representation for illegal immigrants who are considered mentally incompetent.

U.S. District Judge Amir Ali, who took office in 2024, issued a decision on Monday that effectively blocked the Department of Homeland Security (DHS) and the Department of Justice (DOJ) from discontinuing funding for this program. This ruling means that the Trump administration is required to continue the financial backing of initiatives that help illegal immigrants contest deportation orders in immigration courts.

Judge Ali remarked on the administration’s attempts to eliminate the program, noting the harmful impact on individuals deemed mentally incompetent. He indicated that the court found the plaintiff entitled to some preliminary relief, as removing the immigration court’s ability to appoint representatives poses a significant risk to the public interest.

Representatives from both the DOJ and DHS have not yet commented on this decision.

Originally established in 2013 during the Obama administration, the National Qualified Representative Program (NQRP) is funded by the DOJ and DHS to aid detainees with mental health disorders who cannot represent themselves during immigration procedures. Documents indicate that the program serves over 2,000 detained immigrants and consumes approximately $12 million annually.

Reportedly, organizations participating in the NQRP argue that the program offers legal counsel regardless of the individual’s criminal background, which could include serious offenses by some illegal immigrants. The Trump administration sought to discontinue this program in April as part of broader efforts to reduce government expenditures. A group representing immigrants, predicting substantial financial losses due to halted government contracts, filed a lawsuit against the administration to restore the NQRP.

Ali’s ruling was a major triumph for these immigrant advocacy groups, granting a provisional injunction that prohibits DOJ and DHS officials from taking steps to terminate or suspend the NQRP, and reinstating the program as per his directives.

This decision comes amid a multitude of immigration-related legal challenges the Trump administration is facing, including controversies surrounding birthright citizenship and various deportation cases.
