Judge Appointed by Obama Says ICE Can't Quickly Arrest Suspected Gang Member

Federal Judge Blocks Deportation of Kilmer Abrego Garcia

A federal judge intervened on Wednesday to stop the Trump administration from deporting Kilmer Abrego Garcia right after his release from criminal custody.

US District Judge Paula Sinis issued an emergency order, preventing Garcia’s deportation to El Salvador for 72 hours following his release from immigration custody. Garcia, who has been implicated in a long-running human smuggling operation, is currently incarcerated.

Judge Sinis, appointed during the Obama administration, expressed strong criticisms of the Trump administration’s actions in her ruling. “The defendant hasn’t provided sufficient assurances to the court,” she stated, “but it’s crucial to protect Abrego Garcia’s due process rights.”

She further emphasized the need for notifications to prevent deportation efforts that could send him back to El Salvador due to issues surrounding the third country. “Concrete measures haven’t been taken to prevent his immediate return,” she asserted.

Additionally, the judge ordered Garcia to be supervised at the nearest ICE facility in Baltimore, Maryland. Earlier this year, he had been arrested for possible deportation, igniting a political controversy.

Garcia is reportedly a suspected member of the MS-13 gang and has faced allegations of domestic abuse from his American wife. In March, he was mistakenly deported to El Salvador, despite being an undocumented immigrant with a previous order protecting him from repatriation.

This year, he was taken into custody by a Central American country, serving time at a high-security prison before returning to the U.S. facing new charges related to human smuggling.

Back in 2022, Garcia was pulled over on Tennessee’s highways while allegedly transporting eight passengers without luggage. The vehicle, owned by another illegal immigrant, has raised questions about his ongoing legal troubles in Central Tennessee.

According to Department of Justice indictments, from 2016 to 2025, Garcia has helped smuggle undocumented migrants from various countries into the U.S. He reportedly made over 100 trips as part of this operation. In addition to human smuggling, prosecutors allege he was involved in acquiring firearms and drugs in Texas for sale in Maryland.

Despite the judge’s ruling, the Trump administration has continued to assert that Garcia will not be allowed to roam freely in America again. “The fact remains: This MS-13 gang member and human trafficker will never walk the streets of America again,” an official statement declared.
