Judge Stops Deportation Delay for Salvadorian Immigrant

A federal judge in Maryland ruled on Monday that the Trump administration cannot postpone the deportation of Salvadorian immigrant Kilmer Abrego Garcia, despite the ongoing government shutdown. The judge has scheduled a follow-up court appearance for Friday, where officials will be required to testify under oath.

US District Judge Paula Sinis made this decision during a status hearing concerning Abrego Garcia, who was deported to El Salvador in March due to what the Trump administration described as “administrative errors.” He was allowed back into the United States in June but later faced unrelated criminal charges in Tennessee.

Throughout the hearing, Sinis’s frustration grew with the government lawyers who struggled to respond to questions about Abrego Garcia’s detention, often deflecting inquiries regarding plans to deport him to Eswatini, a third country. “You need to come to court prepared,” she admonished a Justice Department lawyer. “The government carries a burden here, and from my perspective, it’s not being met.”

As it stands, Abrego Garcia remains in the United States while the judge considers the case.

Sinis dismissed the government’s argument that the shutdown hindered their ability to provide required information. She expressed disbelief when a Justice Department lawyer returned from a 30-minute break with no new details regarding the case, despite having been granted the time to gather information.

“It’s hard to believe that in just 30 minutes you found no one who could provide additional information,” she remarked. “You must understand I’ll have some basic questions.”

The hearing concluded with an order for all parties to appear again on Friday to address evidence, specifically focusing on the Trump administration’s negotiations with Eswatini concerning the deportation and the timetable for such actions.

Sinis insisted that the government present witnesses who possess firsthand knowledge about the case, criticizing one official who arrived unprepared and stated she had “no idea” about the proceedings.

Also, in August, Abrego Garcia’s legal team submitted an emergency habeas corpus petition aimed at ensuring he remains in the US, allowing him the right to a fair process before any potential removal to a third country.

In her refusal to postpone the hearing, Sinis reiterated her commitment to examining the case thoroughly.
