Judge halts Florida law limiting youth social media accounts

Federal Judge Issues Ruling on Florida’s Social Media Law

A federal judge has issued a preliminary injunction against Florida’s HB 3, a law aimed at regulating youth access to social media. This ruling was made by US District Judge Mark Walker, who determined that the law infringes on First Amendment rights related to free speech.

Judge Walker’s decision, announced on Tuesday, was the result of a lawsuit filed by NetChoice and the Computer and Communications Industry Association, which sought to halt HB 3 until the legal challenges were resolved. Walker stated, “Today’s ruling affirms that the government cannot control or censor online speech. Like all Americans, Floridians deserve access to legitimate speech without government oversight or interference.”

Supporters of the law, including Florida Attorney General James Usmier, expressed disagreement with the ruling. Usmier’s spokesperson argued that social media platforms do not have constitutional rights concerning their products and mentioned that the law would be appealed to the 11th U.S. Circuit Court of Appeals.

HB 3 was designed to prohibit social media use for individuals under 14 and to require parental consent for users under 16. Although scheduled to take effect on January 1, its implementation is now on hold due to the ongoing lawsuit.

NetChoice, which represents various social media companies, successfully obtained similar injunctions against similar laws enacted in Utah and California earlier this year.

In the ruling, Judge Walker acknowledged that while parents have legitimate concerns about their children’s social media use, other aspects of the law could be challenging and should allow families to exercise autonomy. Notably, the ruling did not address some segments of the law that would require social media companies to delete accounts at parental request.
