Impeachment Articles Filed Against Judge Boasberg

On Tuesday, Texas Republican Representative Brandon Gill initiated impeachment proceedings against Chief Judge James E. Boasberg of the U.S. District Court for the District of Columbia.

This move comes after Judge Boasberg approved confidential subpoenas linked to the Biden Justice Department. The investigation, dubbed “Arctic Frost,” has been characterized by conservative leaders as part of a political campaign targeting allies of former President Trump and Republican lawmakers.

“Chief Judge Boasberg has violated judicial impartiality and created a constitutional crisis, shamelessly weaponizing his power against political opponents, including Republican members of Congress who faithfully serve the American people in their jurisdictions,” Gill stated.

In recent days, several Republican senators lodged complaints regarding the judge’s consent to subpoenas and gag orders amidst questionable investigations.

Gill’s resolution charges Boasberg with misusing his authority by approving a secrecy order, commonly referred to as a “gag order,” which allegedly infringes on Congressional privilege and the separation of powers.

“I just filed articles of impeachment against radical activist Judge James Boasberg,” Gill tweeted. He criticized the judge for allegedly misusing the judiciary to target critics of the Biden administration.

“I’m proud to support Rep. Brandon Gill in his impeachment efforts. Judge Boasberg’s actions in the Arctic Frost scandal require accountability,” added Rep. Keith Self, also from Texas.

This impeachment initiative comes shortly after Senate Judiciary Committee Chairman Chuck Grassley declassified FBI documents detailing the extent of the investigation. Launched in 2021 during probes related to election challenges from the January 6 Capitol protests, the inquiry overseen by former special counsel Jack Smith has issued nearly 200 subpoenas for various records from Republican officials.

Notable targets reportedly include at least eight Republican senators—among them Ted Cruz, Lindsey Graham, and Josh Hawley—as well as several conservative nonprofits and figures close to Trump, like Rudy Giuliani and Mark Meadows.

Critics argue that Boasberg’s actions cloak these investigations from those affected and may violate the Speech and Debate Clause, which protects lawmakers from prosecution related to their legislative activities.

Boasberg, who was appointed by President Obama in 2023 and previously led the Foreign Intelligence Surveillance Court, has been involved in several high-profile cases ranging from the Mueller investigation to the January 6 prosecutions. His recent attempts to block the Trump administration’s deportation policy have also sparked significant backlash.

Currently, the impeachment resolution has been sent to the House Judiciary Committee, where Republicans hold a slight edge in a divided party environment. A simple majority is necessary for impeachment in the House, but a supermajority is needed for conviction in the Senate—something that’s currently unlikely given the Democrats’ control.

Gill, indicating the momentum from the 2024 Republican wave, emphasizes commitment to reducing government waste and resisting bureaucratic overreach. He notably won his election against a Democratic incumbent in Texas’ 26th District.

Grassley, whose recent disclosures stirred considerable discussion, has praised Gill’s actions as essential for restoring public trust in institutions. Other Republican senators have echoed this call for accountability, with conservative commentators amplifying the message on social media.

Opponents of the impeachment might draw parallels to “Russiagate” advocates on the left, suggesting the Arctic Frost investigation revealed legitimate leads on possible seditious activities. However, no charges have been brought forward, and recent shifts within the FBI have occurred during the transition to a potential second Trump term.

The unfolding situation highlights the growing divides over oversight, judicial independence, and the political landscape in Washington, D.C.
