DHS Responds to Judge’s Ruling on Kilmer Abrego Garcia
The Department of Homeland Security has made it clear that Kilmer Abrego Garcia will not be allowed to “be free on American soil,” despite a judge’s order for his release from detention pending immigration proceedings.
The ongoing battles surrounding gang-affiliated defendants living in Maryland are reflective of the broader political clash between Democrats and the Trump administration regarding immigration policies.
“We have been consistent in this message, and that remains true,” stated a DHS official after U.S. Magistrate Judge Barbara Holmes ruled that the government failed to demonstrate that Garcia posed a flight risk, thus ordering his release.
Interestingly, the judge also remarked that her ruling felt somewhat “academic,” as it seems likely Garcia will continue to be held by immigration authorities regardless of the court’s decision.
DHS Deputy Director Tricia McLaughlin emphasized Garcia’s status, labeling him as an illegal alien who is a “dangerous criminal.” She reiterated the determination that he will never be released in the U.S.
Garcia had previously been sent back to El Salvador but was returned to the U.S. following a campaign from Democrats that influenced legal actions. Subsequently, more serious charges related to trafficking were filed against him. While he has pleaded not guilty to these new allegations, his legal team argues they’re merely a way to justify his deportation.
A hearing to establish the terms of Garcia’s potential release was set for Wednesday, but the government has already initiated a motion to appeal the ruling.
Supporters of Trump’s more aggressive deportation plans argue that creating a legitimate process for millions of undocumented individuals is a dangerous proposition. “This situation has become a focal point in immigration debates, which are often characterized by crude rhetoric,” said Chris Newman, Garcia’s attorney. “I view this as an essential issue related to fundamental rights and due process.”
The political landscape continues to shift as President Trump himself highlighted a photo showing his tattooed knuckles, allegedly symbolic of MS-13 gang membership, which further complicates the narrative surrounding Garcia.
