Federal Judge Blocks Threats Against Election Workers

A federal judge has issued a temporary injunction against the Trump administration, preventing it from threatening election workers with legal action regarding ballots associated with suspected noncitizens.

U.S. District Judge Trina Thompson determined that the Justice Department and the Department of Homeland Security likely transgressed the Voting Rights Act, particularly its prohibition against voter harassment, by intimidating election workers as the midterm elections approached. This was concerning threats of prosecution for processing ballots from individuals the administration claims are ineligible.

In her eight-page order, Judge Thompson emphasized that a fundamental aspect of a just electoral process is the ability of voters to cast their ballots without intimidation or fear. Her order came just days before the elections set for November 3.

With the Trump administration’s efforts to obtain voter registration data from various states, the administration justified its actions as necessary to safeguard election integrity and curb noncitizen voting.

The restraining order specifically bars federal officials from pressuring state and local election workers to stop processing ballots based solely on allegations of ineligibility. Furthermore, it prohibits the administration from instructing election officials to erase registered voters from the rolls, withhold ballots, or reject ballots based on these claims alone.

This legal action was initiated by labor unions and civil rights groups, such as the Service Employees International Union and the NAACP.

Judge Thompson remarked that it’s vital to protect the integrity of the election process, especially with the actual election date so near and ballots already issued. She noted that many Americans had already begun to vote.

In a separate ruling from earlier that day, a federal appeals court dismissed the Trump administration’s emergency motion to require California to invalidate mail-in ballots for around 20,000 voters labeled as likely noncitizens while their eligibility was still being examined.

The Ninth U.S. Circuit Court of Appeals rejected the Justice Department’s request, marking yet another setback for the administration just days before Election Day.

Judge Thompson also mandated that the administration inform state and local authorities that the prior demands for prosecution have been halted.

The Justice Department has been contacted for comment regarding these developments.
