Judge temporarily blocks Iowa’s new illegal immigration law after Biden admin sues

Federal Judge A preliminary injunction was issued On Monday, he blocked a new illegal immigration bill in Iowa that would have given state police the power to arrest and deport illegal immigrants.

Senate File 2340 The bill was signed into law in April by Iowa Republican Governor Kim Reynolds in response to the Biden administration’s open border crisis.

Biden “left states no choice but to let them do the work for him.”

Reynolds previously said, “The Biden Administration is failing to enforce our nation’s immigration laws, putting the protection and safety of Iowans at risk,” he said of the bill.

“Those who enter our country illegally are breaking the law, but Biden has refused to deport them. This bill gives Iowa law enforcement the power to do what he refuses to do – enforce existing immigration laws,” Reynolds added.

If it goes into effect, the bill would allow Iowa law enforcement to charge illegal immigrants with aggravated misdemeanors if they have an outstanding deportation order, have previously been deported, or are barred from entry. The bill would also allow for felony charges against illegal immigrants who have previously been convicted of a felony or served a deportation order for a drug or crime against the person.

SF 2340 would give judges the power to allow suspects to leave the country instead of facing state charges.

The law was scheduled to come into effect on July 1st.

The Biden administration sued Iowa last month over the new law, arguing that the federal government has “exclusive authority under federal law to regulate the admission and removal of aliens.”

Before filing the lawsuit against Iowa, Chief Deputy Attorney General Brian Boynton told Reynolds and Attorney General Brenna Byrd in a May letter that “SF 2340 is preempted by federal law and violates the U.S. Constitution.”

On Monday, U.S. District Judge Steven Locker issued a preliminary injunction blocking the law from taking effect.

“As a political matter, the new law may be defensible,” Judge Locher wrote in his decision.

“Constitutionally, that’s not the case,” Locher said.

Following the judge’s ruling, Reynolds wrote in a post: X“Iowa’s Stop Illegal Immigration Bill was blocked, leaving us vulnerable to the effects of Biden’s open border policies. Crime, drug overdose deaths and human trafficking are on the rise — all because Biden is not doing his job!”

Iowa Attorney General Brenna Byrd said she plans to appeal the judge’s ruling.

“Biden’s refusal to secure the border has left states with no choice but to do the job for him,” Byrd wrote. X“I intend to appeal today’s court decision that blocks IA from preventing illegal re-entry and keeping our communities safe.”

The Biden administration’s Justice Department also filed a lawsuit. Texas and Oklahoma on similar legislation.
