Special Prosecutor Hank Brennan warned in court Wednesday that he was worried there would be a “ambush trial” if there were no additional disclosures about what the experts said this time.
ARCCA witnesses asked Brennan to testify before the second trial of the read, so they sought to eliminate concerns that the financial relationships were contracted by the defense without revealing. The move was rejected.

He has been seeking disclosure for months since then, saying it was controversially exchanged in court over the matter on Wednesday.

“If this wasn’t that obvious, I wouldn’t be so mad at it,” Brennan told the judge.
Defence counsel Alan Jackson called Brennan’s protest “invasion,” and said ARCCA witnesses were working on a prosecutor’s specialist’s rebuttal that was revealed in February. He said the defense would receive the final report from the expert on March 24th and would take over disclosure as soon as it becomes available.

Canon gave his defense until 5pm on Friday. The opening statement is scheduled for Tuesday.

“By 5pm on April 18, 2025, the defendant is to produce a prominent discovery federally,” writes Canon. “In addition, by 5pm on April 18, 2025, the defendant must federally disclose to the Confederate a member of the ARCCA and the defense team including the defendant on or on behalf of ARCCA, or an oral representation agreement or understanding of oral expression agreement or understanding of payments.”

She added that by noon Monday, the defense must disclose pending tests and results as well as expected dates for completion and results.
