After being arrested on drug charges in April 2015, Zarate was released by local police in San Francisco, despite ICE agents requesting that he be taken into custody for deportation again. Less than four months later, Zarate shot Steinle, killing her.

On November 30, 2017, Zarate was acquitted of Steinle’s murder. Zarate has been charged in Texas with illegally reentering the United States multiple times.
