Rep. Lamonica Mciver to Plead Not Guilty to Federal Charges
Rep. Lamonica Mciver, a Democrat from New Jersey, is planning to plead not guilty following federal charges filed against her earlier this year. These charges stem from a questionable lawsuit and an incident at the Immigration and Customs Enforcement (ICE) Detention Center in Newark, where she was involved in a confrontation that was recorded on camera.
This month, a federal court indicted Mciver on three counts related to forcibly obstructing ICE agents during an event on May 9. She intends to contest these allegations in court.
The Department of Justice has indicated that Mciver’s lawsuit was prepared after a reported incident in which she allegedly impeded federal officials attempting to make an arrest outside the Delaney Hall Federal Immigration Facility in Newark.
The Justice Department detailed that on the day of the incident, Mciver, along with two other council members, visited the facility to conduct an inspection, which coincided with immigration protest rallies. When they entered a secure area, Newark’s mayor showed up and was allowed access. Federal officials subsequently warned the mayor that he wasn’t permitted there and threatened arrest if he didn’t leave. Mciver, alongside her colleagues, overheard this exchange and attempted to confront the officers regarding the mayor’s removal. As law enforcement moved to detain the mayor, Mciver and others surrounded him to stop the officers from handcuffing him.
Moreover, the allegations state that Mciver attempted to restrain an officer by forcefully using her forearm against the officer’s body, which resulted in her pushing against the officer to hinder the arrest. Reports clarify that as law enforcement tried once more to detain the mayor, chaos erupted, with someone shouting to “surround the mayor.” It was during this moment that Mciver allegedly positioned herself around him to obstruct the arrest.
Homeland Security has released footage from the incident, which captures the moments when Democrats were seen pushing officers amid the confrontation.
If convicted on all three charges, Mciver could face a substantial sentence—potentially up to 17 years in federal prison—with individual counts carrying significant prison terms and fines.
