San Jose State University (SJSU) transgender volleyball player Blair Fleming deprived women of opportunities and scholarships, and worse, attempted to physically harm players who objected to joining the team. A lawsuit was filed as a result.
SJSU player Brooke Slusser and several others made the decision to allow Fleming to join SJSU's women's volleyball team without telling the women that he was biologically male and identified as female. He filed a lawsuit against the university and the Mountain West Conference, saying the organization allowed it. fox news Reported.
In the lawsuit, Slusser and the other women claim Fleming's presence on the team threatens their safety, dignity and rights. The lawsuit also alleges that the school's decision to award Fleming a volleyball scholarship affected other women financially and emotionally and deprived them of that opportunity.
The lawsuit also cites allegations from SJSU player Chandler Manuski, who said Fleming violated school rules by sneaking out of the team's hotel during road games. Mr. Manuski also claimed to have heard that Mr. Fleming was conspiring with an opposing player to physically harm Mr. Slusser during the game.
“Coach Manuski also said Fleming said he would “leave center court open,'' so that Malaya Jones could “blow the Thrasser'' with a wide-open shot, meaning Brooke Thrasser. “You'll be able to put a ball in your face,'' the complaint says.
The complaint further states that Manuski alerted team coach Todd Kress and assistant coach Melissa Barry Smooth about the incident and was suspended. Still, Kress maintained that the accusations about Fleming were false.
“Mr. Kress told Ms. Batty-Smooth that he did not believe Ms. Manuski and that he believed she made up the whole story to keep her out of the team hotel and out of trouble. “,” the filing states.
The school later suspended Fleming indefinitely after Batty Smooth filed a Title IX complaint alleging that Fleming had violated the law by allowing him to play.
Batty Smooth disagreed with coach Kress because the Title IX complaint cited allegations made by Fleming to harm Thrasser on the court.
The lawsuit is just one of several targeting schools and sports officials for allowing men to play as women. The NCAA is also facing lawsuits from several organizations over its policy of allowing transgender athletes to play as women.
Slusser told Fox News that if she had been accused of plotting to harm another player, she would have been immediately expelled from the team.
“If this had been me, and if it had been me threatening to do this to a teammate who caused such a fuss, action would have been taken immediately,” Slusser told the cable news station. “I was definitely very angry, and I was happy at first to know that it was already known to the coaching staff and compliance and everyone, but I don’t know if it changed my mind. I was just angry because I didn't think someone would do something like this.”
She also said the school threatened to revoke her scholarship for daring to speak out against Fleming.
Another plaintiff, former San Jose State player Elle Patterson, said she had to drop out of college after losing her scholarship and spot on the team with Fleming's arrival. She said losing her scholarship meant she could no longer afford to attend SJSU.
