A lawyer from Idaho claims the judge handling the Brian Coberger murder case may impose sanctions on the prosecutor or defense team over a leak to the media. This comes after a “Dateline” episode aired on May 9, revealing new data, surveillance footage, and cell phone records linked to Coberger, who is accused of killing four University of Idaho students: Xana Kernodle, Kaylee Goncalves, Madison Mogen, and Ethan Chapin.

The episode featured a surveillance clip showing a car resembling Coberger’s near the victims’ location prior to their deaths. Additionally, it stated that data from an FBI mobile phone tower indicated multiple calls made by Coberger near the tower that served the area close to King Road, where the students were murdered, from July to mid-August 2022.

Judge Stephen Hippler noted in a May 15 order that this breach might arise from someone closely connected to the case and indicated that communication records should be preserved. He outlined specific evidence shown in the episode, including Coberger’s mobile phone content and AT&T records.

Hippler remarked that such a violation could jeopardize the justice process and complicate fair proceedings, increasing the case’s prosecution costs. Legal expert Tara Jalali Malek suggested that if the leak is traced back, there could be ramifications for the involved parties.

While some are concerned about the implications of this leak on fairness, Marek, another legal observer, mentioned that he doubts the trial will be postponed. He stated that all those who breach court orders might face consequences.

Despite the chaos, Marek expressed skepticism about whether the trial could really be called off, emphasizing that the investigation into the leak would continue while preparations for the trial move ahead. Furthermore, unexpected testimony may surface from a DoorDash driver who claims to have been near the crime scene right before the students were killed, revealing a connection she had with Coberger during that time.
