Senator Randpole (R-KY) said on Sunday “Facing the People” of CBS that the court believes defendants should take legitimate procedures before deportation.
Host Margaret Brennan said, “There are legal questions about using these authorities to send detainees without giving them to court. I have questions about how they are being handled with regard to these individuals rejected by El Salvador.
Paul said, “There are some big legal questions here. On the one hand, the Bill of Rights applies to everyone. The Bill of Rights does not specifically designate citizens. It applies to anyone in the United States, the Bill of Rights applies. On the other hand, the act of aliens and enemy says you can't get much of a process.
He continued, “The court will decide that there must be a process.”
Paul said, “I think there's a process that most of the time comes from the court for representation from the court before being deported. I don't know about laws based on foreigners and enemy laws. While I love constitutional law, I'm not a constitutional lawyer. I think it'll go to the Supreme Court.
