A man arrested in Brooklyn last month on suspicion of violently raping a woman (his accomplice held two other women at knifepoint) has been released on supervised release under special circumstances, the New York Post reports. .

Mohamed Izzedine, 22, was arrested on December 28 and charged by police with a number of other crimes, including rape, robbery and false imprisonment, after a judge ruled that prosecutors had not brought charges. He was released from custody earlier this week. Law enforcement officials and Izzeddin's attorney told the Post.

According to local reports, Izzeddin, a Brooklyn resident, is accused of breaking into a store near 9th Avenue and 59th Street on Dec. 23 at around 6 p.m. and raping a 49-year-old woman of Asian descent. ing.

An alleged accomplice, Mohammed Alwi, 25, of Canarsie, was also arrested and charged with rape and other crimes. Police said Alwi allegedly displayed the knife to “keep control” of two other people inside the store, according to the New York Post.

However, he has now been released after Izzeddin lawyer Lance Lazzaro successfully argued to a judge that the DA's office failed to meet a six-day deadline for indictment. Under New York state law, the district attorney's office must file charges within six days of being taken into custody.

Additionally, if an arrest occurs before 9 a.m. on a particular date, the law states that the technical arrest date is the previous day.

Izzeddin was arrested around 3 a.m. on Dec. 28, but was not formally charged until around 1 p.m., ending a six-day timeline for prosecutors and the judge agreed.

Izzeddin suffered an apparent drug overdose in his 68th Street home in the early morning hours of Dec. 28, when paramedics responded. They noticed there was a warrant out for his arrest and called police, according to the New York Post.

Izzeddin was taken to the hospital, where he remained handcuffed and then taken back to the 66th Precinct, his lawyer told the publication, adding that his client “never left free.” .
