Marissa Roy is campaigning for the position of Los Angeles’ top prosecutor, but her plan includes a controversial proposal to halt misdemeanor prosecutions for a period of 100 days.

Candidates aligned with the Democratic Socialists of America (DSA) previously pursued a broader initiative to pause new charges for offenses like trespassing, petty theft, and public intoxication—crimes often associated with life in urban settings.

Some community members, who might engage in such activities during this time, worry that this could lead to a gradual decline in safety, effectively stalling the judicial process.

Roy, in her role, aims to have the authority to determine which cases proceed to court.

When asked if she endorses a complete moratorium on misdemeanor prosecutions, Roy responded to the California Post, stating that she has “never supported a total moratorium on misdemeanor prosecutions,” mentioning that this idea came from criminal lawyers and was taken up by Faisal Gill.

However, internal documents from the 2022 City Attorney race present a more nuanced picture.

Roy was actively involved in discussions about the proposal to suspend misdemeanor charges for 100 days during the campaign, as revealed by exclusive correspondence reviewed by The Post.

This proposal, backed by former City Attorney candidate Faisal Gill, suggests a temporary halt on new misdemeanor charges while the City Attorney’s Office re-evaluates its enforcement policies and enhances its diversion programs.

Former prosecutor Ben Austin remarked that this means “no case will be filed” and suggested that it would lead to a significant erosion of law and order in the community.

Under this plan, various minor offenses such as trespassing, loitering, public intoxication, and other low-level crimes would effectively go unprosecuted. Supporters argue that these offenses stem from issues like poverty and addiction, calling for more supportive measures instead of punitive ones.

Roy emphasizes the need for diversion programs that connect offenders to housing and treatment resources, steering away from a “one-size-fits-all” prosecution approach.

Her platform also explicitly challenges federal immigration enforcement and the policies of the Trump administration, aiming to position the City Attorney’s Office as a defender against such practices.

Roy’s candidacy has received the backing of DSA-LA, which advocates against corporate donations and promotes socialist policies.

Critics argue that the context of these leniency policies is key.

Austin expressed that the already relaxed prosecution policies have had severe repercussions, stating that these leniencies have led to chaos in communities. He relates his thoughts based on firsthand experience growing up in Venice Beach, claiming that these policies have caused significant harm.

He describes a reality where residents face outdoor drug use and repeat offenders cycling back through the system, leaving local residents feeling neglected.

Austin critiques the notion of public safety as a non-issue and stresses its importance in sustaining viable living conditions within the city.

Nonetheless, Roy maintains that her stance on justice and public safety has not shifted. She asserts her engagement with both the deputy city attorney and public defender to promote evidence-based reforms.

Yet, a past social media post from May 2022 that mentioned “pausing new charges” has revived concerns from opponents, emphasizing that the city cannot afford to experiment with enforcement strategies again.

The Los Angeles City Attorney’s Office plays a significant role in prosecuting misdemeanor offenses throughout the city and represents it in civil matters, which heavily influences the enforcement of law.
