A Guatemalan man convicted of serious sex crimes against a minor in Maryland has been released from the Baltimore County Department of Corrections despite a request from Immigration and Customs Enforcement (ICE) to continue detaining him.
ICE announced in a press release that Baltimore’s Enforcement and Removal Operations (ERO) Fugitive Action Team arrested Raul Calderon Interano, 25, near his Baltimore home on Saturday.
Calderon Interino was the first unaccompanied minor to be discovered by U.S. Border Patrol agents when he entered the country illegally on June 19, 2014, near Laredo, Texas.
The Border Patrol notified Calderon Interano to appear before a U.S. Department of Justice immigration judge, and a few days later he was transferred to the Office of Refugee Resettlement in San Antonio, Texas.

On November 8, 2014, he was transferred to the custody of a sponsor living in Maryland.
Nearly a year later, on October 8, 2015, an immigration judge ordered Calderon Interano removed from the United States and deported to Guatemala, but he did not appear for the ruling.
Calderon Interino reappeared on January 23, 2023, when Baltimore County police arrested and charged him with sexual abuse of a minor, attempted sexual abuse of a minor, attempted third-degree sexual offense, third-degree sexual offense, and two counts of second-degree assault.

Following his arrest, ICE ERO Baltimore filed an immigration detention order against Calderon Interiano with the Baltimore County Detention Center.
He was ultimately convicted on April 10, 2024, of fourth-degree sexual offense and second-degree assault, and sentenced to six years in prison followed by five years of probation.
However, the court suspended all of his prison sentence and ordered him to register as a Tier 1 sex offender.

At an unknown date after the ruling, the Baltimore County Detention Center refused to honor ERO Baltimore’s immigration detention order and released Calderon-Interiano from custody.
“Baltimore County remains committed to advancing public safety policies while respecting the constitutional rights of individuals,” a Baltimore County spokesperson told Fox News Digital. “Baltimore County notifies ICE when the National Crime Identification Center presents a civil detention warrant, and we continue to detain individuals with criminal warrants signed by a judge.”
The Elo Baltimore Fugitive Task Force tracked down Calderon Interano at his Baltimore home on May 29, re-arrested him and transported him to the Baltimore field office where he was investigated.
He will remain in ICE custody until he is removed from the United States.
Border crossings surge as election draws closer, prompting President Biden to order most illegal immigration stopped

White House President Trump on Tuesday announced long-awaited executive action to block illegal immigrants from applying for asylum if the number of crossings at the southern border reaches a certain level, a move that comes just months before the November election and could soon face legal challenges from activists.
Biden will issue a presidential proclamation to temporarily suspend the entry of foreign nationals across the southern border if the number of encounters at the border exceeds a seven-day average of 2,500 daily encounters, officials said. This would be in effect until 14 days after the seven-day average of border encounters falls below 1,500. Officials said this will make it easier for immigration officials to quickly remove individuals who do not have a legal basis to be in the United States.

The order includes several exceptions for people coming across the border. It does not apply to visa holders, unaccompanied children, victims of serious human trafficking, or those facing acute medical emergencies or imminent threats to their life or safety. It also does not apply to people using the CBP One app to enter the US at ports of entry (about 1,500 migrants are allowed into the US each day).
The measure would take effect immediately and be accompanied by joint rules issued by the Department of Justice and Department of Homeland Security that would limit asylum eligibility in high-traffic border encounters.
